1. Acceptance of Terms
By accessing and using ADSkyscraper, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our service.
2. Service Description
ADSkyscraper is a digital advertising platform that displays user-submitted advertisements in a progressive pricing model. Each new advertisement is placed above previous ones, with prices increasing by 10% for each new listing.
3. User Responsibilities
By submitting an advertisement, you:
- Confirm you have the rights to all provided content
- Agree to provide accurate and complete information
- Accept responsibility for your advertisement content
- Understand that prices increase progressively
4. Advertisement Placement & Pricing
Newer ads are placed above older ones. The price increases by 10% for each new listing. Prices are calculated automatically based on the number of active advertisements and are non-negotiable. The maximum price is capped at $50,000 to ensure compatibility with standard payment methods. When this limit is reached, manual bank transfer payment becomes available for high-value transactions. When the maximum price is reached, no more positions will be available.
5. Payment Terms
All payments are processed securely via:
- Stripe (credit/debit cards) - for transactions under $50,000
- PayPal - for transactions under $50,000
- Plisio.net (cryptocurrency) - for transactions under $50,000
- Manual bank transfer with deposit - for transactions of $50,000 and above
ADSkyscraper does not store any credit card, banking, or cryptocurrency wallet data. All payment processing is handled by third-party providers.
5.1. Manual Bank Transfer with Deposit System
For transactions of $50,000 or more, the following process applies:
- Immediate Deposit: A $1.00 deposit must be paid immediately via credit card to reserve the position
- 48-Hour Window: You have 48 hours to complete the remaining payment via manual bank transfer
- Deposit Application: If the bank transfer is completed within 48 hours, the $1.00 deposit is applied to your total payment
- Deposit Forfeiture: If the bank transfer is not completed within 48 hours, the $1.00 deposit is forfeited and the position becomes available again
- No Refunds: The deposit is non-refundable under any circumstances
Important: Only initiate a manual payment reservation if you are serious about completing the transaction. The deposit system is designed to prevent frivolous reservations and ensure only serious buyers can reserve high-value positions.
6. Content Restrictions
You may not upload or submit content that is:
- Illegal content: Violates any applicable laws or regulations
- Adult/Pornographic content: Explicit sexual content, nudity, or adult-oriented material
- Harmful or dangerous: Promotes violence, self-harm, or illegal activities
- Hateful or discriminatory: Content that promotes hate, discrimination, or harassment
- Intellectual property violations: Copyrighted material without permission
- Malware or harmful code: Files containing viruses, trojans, or malicious software
- Spam or misleading: Deceptive, fraudulent, or spam content
- Political extremism: Content promoting extremist political views
- Drug-related: Promotion of illegal drugs or drug paraphernalia
- Weapons: Promotion of illegal weapons or violence
Important: We reserve the right to remove such content immediately without refund. This includes content that violates US, EU, or other applicable laws and regulations.
6.1. File Upload Security
All uploaded files are subject to automatic security scanning:
- Virus detection: All files are scanned using ClamAV antivirus software
- File validation: Only JPEG images with valid MIME types are accepted
- Content verification: Files must be genuine image files, not disguised executables
- Size limits: Maximum file size of 10MB applies
Files that fail security checks will be rejected automatically. We do not store or process files that contain viruses or fail validation.
7. Refund Policy
All purchases are final. Refunds are only issued in case of technical errors directly caused by our system. No refunds are provided for:
- Content removal due to policy violations: Including but not limited to adult content, illegal material, hate speech, copyright violations, or any content that violates our Terms of Service
- User error or change of mind: Mistaken purchases, typos, or simply changing your mind
- Service interruptions beyond our control: Technical issues, server downtime, or third-party service failures
- Account suspension or termination: Due to violations of our Terms of Service
- Content that gets flagged or removed: Even if initially accepted, content that later violates policies will be removed without refund
Important: By purchasing an ad spot, you acknowledge that you have read and agree to these refund terms. We do not provide partial refunds for partially used services.
8. Boost Feature & Limitations
The boost feature allows you to make your advertisement more prominent for 30 days. Boost slots are limited in number and may not always be available. When all boost slots are occupied, the boost feature will be temporarily unavailable until a slot becomes free. Boost availability is determined by system capacity and cannot be guaranteed.
9. Intellectual Property
You retain ownership of your advertisement content. By submitting content, you grant us a license to display it on our platform. You must have the rights to all content you submit.
10. Limitation of Liability & User Content Disclaimer
ADSkyscraper is provided "as is" without warranties. We are not liable for:
- User-generated content: We do not review, endorse, or take responsibility for any content uploaded by users
- Content accuracy: We are not responsible for the accuracy, legality, or appropriateness of user-uploaded content
- Third-party content: We are not liable for any content, links, or materials provided by third parties
- Indirect or consequential damages: Including but not limited to lost profits, data loss, or business interruption
- Service interruptions: Technical issues, maintenance, or downtime
- Content removal: We are not liable for any damages resulting from content removal due to policy violations
- Legal consequences: Users are solely responsible for any legal consequences of their uploaded content
Important: By uploading content, you acknowledge that you are solely responsible for the legality and appropriateness of your content. We act as a neutral platform and do not assume any responsibility for user-generated content.
11. Privacy & Data Protection
Your privacy is important to us. We collect and process data as described in our Privacy Policy. By using our service, you consent to such processing. Customer information is handled differently based on payment method:
- Standard payments: Your name and email are forwarded to payment processors for receipt delivery only
- Manual bank transfers: Your name and email are temporarily stored for admin verification and payment processing
12. Charity Voting System
To ensure fair voting in our charity donation system, we collect and securely store IP addresses of users who participate in the poll. This data is used exclusively to prevent duplicate votes within the same calendar month.
13. Termination
We may terminate or suspend access to our service immediately, without prior notice, for any reason, including breach of these Terms.
14. Changes to Terms
We may update these Terms at any time. Continued use of the site after updates constitutes acceptance. We will notify users of significant changes.
15. Governing Law
These Terms are governed by applicable law. For EU users, EU consumer protection laws apply. For US users, applicable US laws apply.

Important: Due to international sanctions and regulatory requirements, our service is not available to users from the following countries and regions:

- Eritrea
- Iran
- Iraq

- Ukraine regions: Crimea, Donetsk People's Republic, Luhansk People's Republic, Kherson region, Zaporizhzhia region
Users attempting to access our service from these restricted regions will be unable to complete transactions. This restriction is in compliance with international sanctions and regulatory requirements. By using our service, you confirm that you are not located in any of these restricted regions.
